TERMS & CONDITIONS

By using the online booking systems (including but not limited to forms on our website, through emails, ticketing sites such as Eventbrite, Facebook, and Art-mate) to attend or participate in our events or classes regardless of whether it is in-person, virtual or video conferencing event, you are deemed to have agreed to the following terms and conditions. These terms and conditions may be updated or revised from time to time. 

​[A] GENERAL TERMS AND CONDITIONS

  1. Rhythm of Life Co. (hereinafter referred to as the "Company" or "we/us/our") reserves the right to make changes to the contents and schedule of our events and classes regardless of whether it is in-person, virtual or otherwise (the "Activity") at any time without notifying participants, students and/or their parents, guardians, and associates  (the "Participants" or "you/your").

  2. We reserve the right to decline any registration and/or to refuse entry or to remove any of the Participants from the Activities without giving a reason. 

  3. By submitting form(s) on our website, or any other booking platforms, you will be added to our mailing list so we can update you on future activities. You may unsubscribe from it at any time. We will not share your personal data with any third party for any reason.

[B] CONSENT, WAIVER AND RELEASE OF LIABILITY 

  1. The Participants, clients or hirers acknowledge the nature of the Company's business and its need to train staff, evaluate and monitor our service quality, provide references to clients, and develop and promote our work in order to be sustainable in the market. Therefore, by booking or registering for the Activities, all Participants, their associates, parents and/or guardians, unless otherwise specifically stated in writing to the Company, give consent to the Company for the use of their images, including but not limited to photographs, videos, and audio recordings (hereinafter collectively referred to as "Images") of them in all formats and settings, for staff training, development, evaluation, quality assurance, clients reference, marketing and promotional purposes by the Company, its affiliates and associates in all formats.

  2. You release the Company, its affiliates, and each and all persons involved in our Activities from any liability relative to the publication and dissemination of Images of you, your child, employees, colleagues and associates.

  3. You release the Company, its affiliates and all persons involved in our Activities from any liability related to any injury, accident, illness, death, loss or damages of your personal belongings that happen before, during and after the Activities. Your well-being and safety are your own responsibility. You must perform within your physical abilities and participate in activities that you are able to follow and perform only. Parents, caregivers, and other adult members must watch and look after their children at all times. 

  4. You fully understand that your consent is given as a condition and prerequisite to your attendance and participation at every and all of our Activities of all kinds of formats.

 

[C] NOTES TO PARTICIPANTS, ATTENDEES, STUDENTS, PARENTS/GUARDIANS

  1. Registration for classes, workshops, or events will be taken on a first-come-first-served basis, and will only be confirmed and accepted on receipt of your payment. Confirmation of acceptance or attendance to a class or an event will be sent by email or by WhatsApp within 3 days of receipt of your payment. 

  2. The registration reserves your place or your child’s place but is not confirmed until payment is received and the confirmation email or WhatsApp message (or E-Ticket) has been sent by the Company. If the class or event is full, you will automatically be placed on a waiting list and the Company will contact you when a seat becomes available. 

  3. If a class or event doesn't fill up to its minimum number of students/attendees/participants (which is listed on the online registration form), the class, programme or event will be cancelled and you will get a full refund.

  4. Once registered, requests to withdraw yourself or your child should be made in writing and will be subject to an administration fee of HK$200 per person/child.

  5. If/when the teacher or presenter is not available due to sickness or otherwise, we will provide a substitute teacher or presenter. If/when that is not possible, we will arrange a make-up class or postpone the event. The final decision will be made by the Company. 

  6. We will not, under any circumstances, give refunds for classes or events that are already paid for. In the same manner, we will not offer make-up classes when students missed a class(es). We will not deduct the missed class(es) lesson fees from a different (the next) course fee. 

  7. All classes and events are conducted in English unless otherwise specified. 

  8. Babies under 8 months old who can share a seat with his/her parent/carer are free to join our ticketed events. (Some of our events are for 18 years old or above only.)

  9. When the number of participants exceeds the number that is set in each one of our Party Packages, HK$200 per additional child and $220 per additional adult (to whom we provide a drum and a seat) will be charged. The Client must inform the Company of the final number of drumming participants at least 48 hours prior to the programme time. 

  10. In the event of unforeseen circumstances beyond our control that pose threats to health and safety such as a pandemic or disruption by civil unrest, the Company reserves the right to provide online classes and/or other alternative programmes. If this situation arises, we will keep in regular contact with you by email. There will be no refunds, credit notes or transfer of fees in this situation.  Should the government inform us that we are unable to run the activities, then all activities will go online for the full length which was previously advertised but in this new format.

  11. All classes and events will be cancelled in the event of Typhoon Signal 8 or higher, or a Black rain warning if hoisted at 8 am for morning classes/events and 12 noon for afternoon classes/events and 3 pm for evening classes/events. For groups that run within school premises, we follow their weather policies and will update you as needed by email. No refunds, make-up classes or credit notes will be made in the event of cancelled classes due to weather.

  12. All terms and conditions written on this page apply to our classes, programmes, seminars, and events. 

 

[D] DISCOUNT COUPONS/VOUCHERS 

  1. Coupons/Vouchers (hereinafter "Coupons") issued by us (Drum Jam, a.k.a. Rhythm of Life Co.) are not transferable and are not redeemable for cash and cannot be combined with other coupons, discounts or promotions offered by us. 

  2. Each coupon is valid for a limited time and expires on the date specified on the coupon. 

  3. Coupons can be used for all our services which you order directly from us (Drum Jam, a.k.a. Rhythm of Life Co.). These services include kids and adult parties, team building, school programmes, etc. 

  4. Coupons cannot be used for ticketed programmes which you order your tickets through other companies such as ticketing sites (i.e., Art-Mate, URBTIX, Eventbrite, Facebook, etc.).

[E] LOSS/DAMAGE OF MUSICAL INSTRUMENTS

  1. Under the rare circumstance that a piece of Rhythm of Life Co. provided equipment is lost, damaged or broken at our event or after our event, and if such loss or damage was caused by the Client, attendee or student (i.e., you, your associates, staff, employees, cleaners, helpers or your child),  the minimal cost will be charged to the Client, attendee or student's parents to cover either repair (where possible) or replacement of the item. This applies to the rented instruments at your event or class. 

[F] DELIVERY OF MUSICAL INSTRUMENTS and ADDITIONAL CHARGES

  1. Our equipment is packed and delivered in a number of trolleys. There will be additional charges for an event at a venue where delivery of our equipment is difficult (i.e., upstairs with no lift, lift too small (the width must be 70cm or wider), steps or stairs before the lift or entrance, a rooftop floor that can be reached only through stairs, etc.).  

  2. The amount of additional charge will be determined by the Company when they receive information (i.e. photos,  videos, maps, etc.) from the Client (hirer).  The Client must inform the Company before they issue an invoice however, when difficulties arise or obstacles are found on the event day, the Company will charge the additional fee and it is payable by the Client immediately. 

You fully understand that your consent to all the above is given as a condition and prerequisite to your attendance and participation at every and all of our Activities of all kinds of formats.
